Alderwood Capital LLP (“Alderwood Capital”, “us”, “we” or “the Firm”), is an investment manager for clients and alternative investment funds. Our affiliated company, Alderwood Capital Services Limited, is a services provider to Alderwood Capital LLP and is the data controller for both this website and activities in relation to those provided services, including where we interact with the personnel of service providers or other suppliers or counterparties. Unless and until you make a decision to engage in a business transaction with us or one of our group companies you are not required to provide us with any information although please note that our website may automatically collect certain technical data (further details on this are set out below).

(iii) How we will use this information and our lawful basis for processing

We will use this information for the following purposes:

a. to correspond with you and maintain our service provider/counterparties contact details list (this is in our legitimate interests in responding to your enquiry or otherwise communicating with you in the course of our business and maintaining our records);

b. to ask you to participate in one of our surveys or ask you to provide feedback to us, or to otherwise undertake business development and marketing activities in relation to making suggestions and recommendations to you about products or services that may be of interest to you and maintaining our business development contacts database (this is in our legitimate interests in promoting and developing our products and services and growing our business. Please also see section (iv) below in relation to marketing);

c. in order to carry out KYC, client onboarding, anti-money laundering and anti-financial crime screening and measures (this is necessary for our compliance with our legal obligations and our legitimate interests in complying with our legal and regulatory obligations);

d. to administer and maintain our website and improve the user experience on our website through the use of cookies. Further information about our use of cookies is set out below (this is in our legitimate interests in running our website, keeping our website updated and relevant, and improving user experience).

In addition, please note that we may also process your information where we are required by law to do so or if we reasonably believe that it is necessary to protect our rights and/or to comply with judicial or regulatory proceedings, a court order or other legal process.

  • other entities within our group for the above mentioned purposes, as part of our regular reporting activities in company performance, in the context of a business reorganisation or group restructuring exercise or for assistance in relation to marketing and business development;
  • professional advisers including lawyers, bankers, auditors and insurers to the extent such information is relevant to their performance of their services;
  • any of our service providers where such information is relevant to their performance of their services.

We may also need to share your information with third parties in the context of the possible sale or restructuring of the business, in order to comply with legal or contractual obligations, as required by or as we reasonably believe is necessary to comply with laws or regulations (e.g. court, tribunal, regulatory authority or governmental entity).

We may transfer the information we process about you to the Channel Islands (comprising Jersey and Guernsey), the Republic of Ireland and the United States of America where the parties listed above are based for the purposes outlined above. The Republic of Ireland is part of the EEA and therefore subject to the EEA laws on data protection; the Channel Islands have been deemed to provide an adequate level of protection for personal data by the European Commission; the United States of America does not have the same standard of data protection laws as the EEA or the UK and so for such transfers we will (or will require a processor to) put in place appropriate safeguards such as standard contractual clauses to ensure that your personal data is treated in a manner that is consistent with and respects the EEA and UK laws on data protection. (vi) How long we will keep your information

We will retain your information for as long as necessary to fulfil the purposes for which it was collected, including for the purposes of satisfying any legal, regulatory, accounting or reporting requirements and our legitimate interests in maintaining such personal information in our records. This will normally include any period during which we are dealing or expect to deal with you and what we consider to be a suitable period thereafter for our internal record-keeping purposes. In doing this we will have regard to the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements. Generally, information relevant to our dealings with you will be stored for a period of 7 years from our last successful contact with you.

Where you have provided your consent to the processing of your personal data for a specific purpose, you have the right to withdraw your consent at any time, without affecting the lawful processing of data based on consent up to the point of its withdrawal. You also have the right to receive your personal data that you provided to us in a structured, commonly used and machine-readable format and have the right to transmit such data to another controller without hindrance from us. In exercising your right to data portability, you have the right to have your personal data transmitted directly from a controller to another, where technically feasible.
